| 1. General Entry 1.1. Information on how to participate in the ‘Bonus $50’ promotion (the “Promotion”) form part of these Conditions of Entry. 1.2 The Promoter/ or TABCORP is Tabcorp Holdings Ltd, 495 Harris Street, Ultimo NSW Australia, ABN 66 063 780 709 (the “Promoter”). 1.3 Entry is open to all residents of Western Australia (WA), Tasmania (TAS) and the Australian Capital Territory (ACT) aged 18 years and over (the “Eligible Participants”). 1.4 Directors, officers and employees of, or contractors to, the TABCORP group of companies, their immediate families and all TABCORP agencies and companies associated with this promotion are not eligible to enter. 1.5 For the purposes of clause 1.4 above, "immediate families" means a spouse (including de facto), parent, sibling, child, grandparent, grandchild, or parent in law and includes stepparents and stepchildren and half siblings. 1.6 All Eligible Participants consent to the publication of their name and suburb of residence (however their full address will not be published) and agree to participate in reasonable promotional activities as requested by the Promoter. 2. Term of Promotion The Promotion commences at 06:00 (AEST) on 27 May 2009 and continues until terminated by the Promoter (the “Promotional Period”). The Promoter reserves the right to terminate the Promotion at any time. 3. How to Participate in Promotion 3.1 Eligible Participants’, must, during the Promotional Period, open a TAB Sportsbet account with the Promoter and, at the time of opening their account, make a minimum deposit of fifty dollars ($50) (the “Initial Minimum Deposit”). 3.2 The Bonus Credit will be deposited into the Eligible Participants’ new TAB Sportsbet account within two (2) Business Days of the Eligible Participant successfully opening their new account and making the Initial Minimum Deposit. For the purposes of these Conditions of Entry, Business Days means any day that is not a Saturday, Sunday or Public Holiday in Victoria. 3.3 The Bonus Credit cannot be redeemed for cash or transferred. Money amounts are in Australian dollars. 3.4 The Promoter reserves the right to refuse to award the Bonus Credit to any Eligible Participant if the Promoter or its agents have reason to believe that these Conditions of Entry, or any Australian Law, would be contravened by such an award. 3.5 Each Eligible Participant is entitled to open one account only and is entitled to a maximum Bonus Credit of fifty dollars ($50) only. 3.6 The full amount of the Eligible Participants’ Bonus Credit ($50) and Initial Minimum Deposit ($50) must be turned over (that is, wagered in a single or in multiple bets) at least once (X 1) after the Bonus Credit is deposited into the Eligible Participants’ TAB Sportsbet account as contemplated in clause 3.2, by the Eligible Participant using their TAB Sportsbet account, before the Bonus Credit and Initial Minimum Deposit ($50) can be withdrawn from the Eligible Participants’ TAB Sportsbet account. 4. General Conditions 4.1 Any GST which may be payable as a consequence of this offer is the sole responsibility of the Eligible Participant. The Promoter accepts no responsibility for any tax implications that may arise from the Promotion. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market value. 4.2 Programming and other quality control errors will not invalidate an otherwise valid Promotion claim. Unless otherwise due to fraud or ineligibility under these conditions of entry, all valid Promotion claims will be honoured. 4.3 If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion. 4.4 The Promoter accepts no responsibility for any loss incurred in the event that any or all of the relevant sporting events are cancelled for any reason beyond the control of the Promoter. 4.5 The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the Promotion except for any liability that cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by a computer user or for any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries. 4.6 The Promoter reserves the right, at anytime during or after the closing date of the Promotion, to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these terms and conditions. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 4.7 No responsibility is accepted for late, lost or misdirected redemptions. 4.8 The Promoter reserves the right to refuse to allow a participant to take part in any or all aspects of the Promotion, if the Promoter determines, in their absolute discretion, that a participant is not in the mental or physical condition necessary to be able to safely participate in the Promotion. It is a condition of accepting the Promotion that the participant may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 4.9 The Promoter complies with the National Privacy Principles contained in the Privacy Act 1988 (Cth). All entries remain the property of the Promoter. By accepting the Promotion, unless otherwise advised, each Eligible Participant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages, subject to the law of privacy. Entrants’ personal information may be disclosed to State and Territory agencies if requested under relevant legislation and in compliance with privacy laws. A request to access, update or correct any information should be directed to the Promoter. For more information read the Promoter’s Privacy Policy located at tab.com.au. 4.10 To the extent that a situation or issue arises for which these Conditions of Entry make no provision or in relation to which the relevant terms and conditions are unclear, the Promoter also reserves the right to make a decision regarding such situation or issue in its sole and absolute discretion and such decision will be final and binding. 4.11 The Promoter’s decision is final and no correspondence will be entered into. |
